What should a woman consider when choosing a divorce attorney?
Depending upon which option she chooses, she should find an attorney who will advise her of her legal options and to help her make a determination of which method fits best as to her situation. Some attorneys just want to litigate, so a woman should find out the ideology of the attorney and see if it matches hers.
What can a client do to best assist you in doing your job as her divorce attorney?
Placing all of their cards on the table. Being open, honest and forthcoming. Attorneys cannot help those who hide matters that are later exposed in a bad way.
The best client will look to resolve their differences quickly and will not play games.
What do you find is the most common battle between high conflict couples?
Usually money and custody of the children, although in many cases the money and the children are just cover ups for deep rooted anger about other matters.
What would you say to a woman that was insisting on having her day in court?
It all depends. If she has received inequitable responses from the other side, she may not have a choice, but to have her day in court. But if she wants to go to court just to express anger, then it is not appropriate.
What advice would you give a client that was being bullied, threatened or coerced by her husband?
That is a woman who needs her day in court. She may have a domestic violence case or need to call the police depending on what is happening. Her lawyer should not allow that to happen, and his lawyer should keep him from doing same.
Under what circumstances would a judge grant sole physical and legal custody to a parent?
If it is in the best interests of the child(ren). In Florida, time sharing between two parents is recommended unless one of the parents is unfit or is not interested. In other states, again it would be the best interests of the child.
What should a woman do if her attorney does not respond to telephone messages or emails?
Attempt to again contact the attorney to see if maybe he or she are on vacation or something happened to them. If they never get back to the woman, she should fire them and seek new counsel.
How often do you see cases of Manimony?
Rarely, but it is going to be changing. Today many households have both parents working and the women are making more money. Depending on the state, the person with the inferior financial ability can seek alimony against their spouse whether the person is male or female.
What advice would you give a woman regarding social media and texting during the divorce process?
She should be very careful as to what she posts. If there is a custody battle, and she posts pictures of her taking shots at a bar, it would not be very smart.
Is there any other advice you would like to give women who are just beginning the divorce process?
I am a firm believer in the Collaborative Law Process. That is when the couples and their respective attorneys enter into a participation agreement to commit to settlement. Neutral experts are brought in when needed, and 90% of the cases get settled within 4 sessions. This is superior to mediation since a mediator cannot give legal advice to the parties. Unfortunately, not everyone is educated as to how this process works and instead run to find an attorney who will instantly file for divorce, and turn the process into an antagonistic fight.
